1. Acceptance of Terms

Welcome to FivShop. By using our website at fivshop.com, our mobile application, or any of our associated services (collectively, "Service"), you agree to comply with and be bound by the following terms and conditions. If you do not agree to these terms, please do not use our Service.

2. Eligibility & Account Creation

To access certain features of the Service, you must create an account. You represent and warrant that all information you provide is accurate and current. You are solely responsible for maintaining the security of your account credentials.

• Registration: You must be at least 18 years old or the legal age of majority in your jurisdiction to create an account.
• Multi-Account Access: FivShop allows switching between Regular, Business, Staff, and Rider profiles. Users are responsible for the compliance of every profile under their identity.

3. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of FivShop and its licensors. Our trademarks, logos, and UI patterns may not be used in connection with any product or service without our prior written consent.

Any feedback, comments, or suggestions you may provide regarding FivShop is entirely voluntary and we will be free to use such feedback as we see fit and without any obligation to you.

4. User Conduct & Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Systematic retrieval of data or other content from the Service to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
• Tricking, defrauding, or misleading us and other users, especially in any attempt to learn sensitive account information such as user passwords.
• Circumventing, disabling, or otherwise interfering with security-related features of the Service.
• Using the Service for any illegal or unauthorized purpose, such as trade of prohibited goods.
• Misusing rider or staff identities for non-business related interactions.

5. Payment & Subscription

Some features of FivShop may be subject to fees or subscription models. By choosing a paid service, you agree to pay FivShop the fees indicated for that service. Payments will be charged on a pre-pay basis on the day you sign up and will cover the use of that service for the specified period.

6. Termination Clause

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service or request account deletion via our support channels.

7. Limitation of Liability

In no event shall FivShop, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service.
• Any conduct or content of any third party on the Service (e.g., rider behavior or shop quality).
• Any content obtained from the Service.
• Unauthorized access, use or alteration of your transmissions or content.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Bangladesh, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

9. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
